You Have Been Served With An Eviction Summons

Housing · Better Living Assistance Help Centre

If your landlord has filed in county court, you will be served with a summons and complaint. This is the most important deadline in the whole process.

You have five days to respond

From the day after you are served, you generally have five business days to file a written answer with the court. Weekends and legal holidays do not count. If you miss it, the court can enter a default and the case is effectively over.

Rent usually has to go into the court registry

In most non-payment cases you must also deposit the rent the landlord says is owed into the court registry, or ask the court to decide what is owed. Filing an answer without dealing with the money is the single most common way tenants lose.

What we do

  1. We read your request the same business day.
  2. We help you understand the paperwork and the deadline.
  3. We support you in preparing a 5-day answer.
  4. Where funds allow, we help with the money owed.

Call 407-242-3975 as well as sending the form. Do not wait for an email reply when a court clock is running.
